Food Establishment License or Health License

Food Establishment License or Health License is required by the Ministry of Health under the Food Safety Act 2003 in order to operate food businesses.

How this can be obtained from the Council:

  • New food businesses need to lodge building plans and obtain building completion certificate from Council.
  • Obtain Ministry of Labor and National Fire Authority Compliance Certificates.
  • Food businesses also need to furnish copy of business registration, FRCA tax registration certificate and valid identification card.
  • Obtain invoice from Councils health department and make payments at Ministry of Health office at Vidilo House.
  • Make application at Councils health department  by submitting copy of receipt obtained from Ministry of Health and completing the health license application form.
  • Health License is finally issued by Ministry of Health head quarters in Suva.
  • Health license needs to be renewed yearly by January.

Council works in partnership with the Ministry of Health and other stakeholders in terms of:

  • Enforcement of Food Safety Act 2003 and Food Safety Regulation 2009.
  • Addressing food safety complaints from consumers.
  • Routine surveillance and audits to ascertain compliance by food businesses.
  • Take appropriate actions against food businesses operating in contravention to the food safety legislations.
  • Awareness for consumers and food businesses.
  • Conducting restaurant grading of eateries.
  • Facilitate import and export of food products.

Is operating food business without health license an offence?

Yes, It is an offence under Section 16 (1)(2) and 66 of the Food Safety Act 2003 to operate food business without a valid health license and offenders are liable on conviction to a penalty of up to $10,000.00 or five [5] years imprisonment.
